Chapter 13 Bankruptcy is a reorganization of debt that can eliminate some debt, and spread others out over a manageable period of time.

For many, Bankruptcy is the best solution for getting out of debt and getting a "fresh start". If you have questions about Bankruptcy, please contact Stephen R. Williams at the law firm of Williams, Ristoff & Proper in Trinity Florida.

CHAPTER 7 BANKRUPTCY
In order to file for Chapter 7, you will need to qualify through a means test.  This test uses a formula to analyze your expenses and income to determine if you are eligible.  Attorney Williams can help you find out whether or not you qualify for Chapter 7.

There are many steps in the Chapter 7 process, including:

Filing a Petition on your behalf

Attending the Creditors meeting

Credit Counseling

Financial Management Course

Discharge Order

What are the results of Chapter 7

The process typically takes about six months, depending on the details of your case.  Once your petition has been approved and you have completed the process, your unsecured debt will be discharged.  Once you are free of the debt, you no longer are required to pay it back. You have a fresh start, and can work toward rebuilding your credit.

If you would like to learn more about Chapter 7 and how it will affect your future and finances, we are only a phone call away.  We have been in the New Port Richey / Trinity Area since 1972.  At Williams, Ristoff & Proper, we are committed to protecting your best interests and helping you achieve a better financial future through debt relief.  Our goal is to ensure that you have the support you need every step of the way through the bankruptcy process.

CHAPTER 13 BANKRUPTCY

Chapter 13 Bankruptcy is an option for those who do not qualify via the means test, for a Chapter 7 Bankruptcy. It is often referred to as "Reorganization Bankruptcy" in which one can eliminate some debt and have the remainder scheduled out over a period of years, based upon your ability to pay. Chapter 13 involves a payment plan between 36-60 months.  Upon completion of the plan, your debts will be discharged, and you can begin to rebuild your finances with a fresh start.

One reason many people choose a Chapter 13 Bankruptcy, is the desire to keep their home. In many cases, depending on the value of, and equity in your home, a Chapter 13 also can stop a foreclosure, even if you’ve been given a date of sale.

A Chapter 13 Bankruptcy can also stop, and in some cases, even reverse a vehicle repossession. Contact Stephen R. Williams at Williams, Ristoff &  Proper P.L.C. for a free confidential consultation.
